Man & Machine sues Apple, Inc. and CBS over “Mighty Mouse”

Apple-wireless-mighty-mouse.jpgApple, Inc and CBS are facing a lawsuit. Man & Machine, a computer accessory company, has filed lawsuits against both companies regarding the mighty mouse.

Man & Machine has sued Apple for trademark infringement. Man & Machine unveiled waterproof & chemical resistant mice to labs and hospitals a year before Apple started selling its Mighty Mouse. The Apple Mighty Mouse (I use the wireless mighty mouse) is a multi-button USB or bluetooth mouse. It was released on August 2, 2005. Man & Machine is claiming that its earlier use beats out Apple, although Apple sells more products.

“Because of Apple’s size, fame and large advertising budget, Apple’s use of the Mighty Mouse trademark has and will continue to overwhelm M&M’s use,”Man & Machine stated in their complaint.

Mighty Mouse is based on the 1942 animated superhero which happens to be a mouse. Mighty Mouse was created by the Terrytoons studio for 20th Century Fox. The trademark rights for the term “Mighty Mouse” is partially owned by CBS. Man & Machine is accusing New York based CBS of licensing “Mighty Mouse” for computer devices when its trademark doesn’t cover such goods. Man & Machine & CBS are now challenging each other for approval at the U.S. Patent and Trademark office.

Man & Machine is based in Landover, Maryland. They’ve been in business since 1982. Man & Machine is an international supplier of cutting edge water resistant computer accessories its products are used in hospitals, medical laboratories, and industrial environments.

    I worked for this guy in the ’80’s and left after our paychecks bounced continuously. He was on Hamilton street in Hyattsville back then. Clifton, the owner was an idiot, who was funded by his wealthy parents. This guy is a total idiot and this case should go nowhere.

    Hyattsville, MD is about 30 minutes from where I live in Maryland.

    I’ll be watching this one closely. I’m curious to find out the outcome of this case.
