PsyStar changes legal teams, plans to hit Apple with ‘guns blazing’

The Miami, Florida-based Mac cloner has tried a range of legal and delaying tactics in its legal fight. The company’s latest questionable move is the hiring of the lawyers that have represented Jammie Thomas, the Minnesota mom who took on the RIAA and lost to the tune of $2 million in fines.

TG Daily reports that PsyStar has hired new legal representation and has pledged to fight Apple with “guns blazin’.” Thereupon, PsyStar dumped their previous lawyers via a quick bankruptcy that was over and done in under two months.

“Psystar has always been more a Cowboy than a Hippie. Now we’ve changed lawyers to better reflect who we are. Camara & Sibley LLP has officially become our primary legal counsel in our ongoing litigation with Apple,” Psystar confirmed in an official statement. “A new trial date has been set for January 11, 2010, in federal court in San Francisco. [The firm] will be ready to fight for Psystar, guns blazin’.”

Flaming jets of hyperbole

Interestingly, after several changes in defense tactics, PsyStar has said it plans to continue pursuing a copyright angle of attack, though legal experts have said the company stands little chance if they use that approach.

“Apple can’t tell an applications developer that it can’t make a piece of Mac-compatible software. They can’t forbid Mac users from writing blogs critical of Apple. And they can’t tell us not to write kernel extensions that turn the computers we buy into Mac-compatible hardware.”

There’s a certain appeal to such arguments—stickin’ it to the man and all—but it seems highly unlikely that company will prevail given the previous court rulings against their “evolving” tactics and the weight scholarly opinion posted around the Web.

Should PsyStar just pack it in or is there some value in dragging this out indefinitely? I’m guessing whatever fines and penalties the court eventually chooses to impose won’t be diminished by the length of the proceedings…
