New Apple Mighty Mouse coming soon? Not so fast, says USPTO

October 8, 2009

About 18 months ago, an unknown maker of input devices for the medical industry sued Apple and CBS over the “Mighty Mouse” trademark. On Tuesday, October 6, the the United States Patent and Trademark Office (USPTO) ruled against our favorite fruit company, leaving in doubt what name Apple’s new input device will come to market with.

Man & Machine has announced the USPTO has awarded the company exclusive right to use the Mighty Mouse trademark as it relates to computer mice in these United (though often dysfunctional) States.

“Others have used the name Mighty Mouse for their computer mice and have sought registration of that trademark, but now the United States government has spoken,” said Clifton Broumand, CEO and Big Cheese, Man & Machine, Inc. “We look forward to the continuation and expansion of the Mighty Mouse line of waterproof mice.”

Man & Machine Might Mouse input device and CBS, which owns the rights to the original rodent-flavored super hero, back in May 2008.

So, although it’s all but certain that Apple plans to release a new mouse alongside a speed bumped entry-level Mac mini and updated prosumer iMac, there’s obvious reason to doubt it will continue to carry Mighty Mouse name.

Thereupon, should Apple license this trademark from Man & Machine in order to continue the franchise? Perhaps an iMac hockey puck mouse revival is just around the corner…
